NRA says Congress will not pass weapons ban

WASHINGTON (AP) ? The powerful gun lobby is gauging enough support in Congress to block a law that would ban assault weapons, despite promises from the White House and senior lawmakers to make such a measure a reality.

Senators plan to introduce a bill that would ban assault weapons and limit the size of ammunition magazines, like the one used in the December shooting massacre that killed 27 people, most of them children, in Newtown, Conn. Democratic Sen. Dianne Feinstein of California has promised to push for a renewal of expired legislation.

The National Rifle Association has so far prevented passage of another assault weapons ban like the one that expired in 2004. But some lawmakers say the Newtown tragedy has transformed the country, and Americans are ready for stricter gun laws. President Barack Obama has made gun control a top priority. And on Tuesday Vice President Joe Biden is expected to give Obama a comprehensive package of recommendations for curbing gun violence.

Still, the NRA has faith that Congress would prevent a new weapons ban.

"When a president takes all the power of his office, if he's willing to expend political capital, you don't want to make predictions. You don't want to bet your house on the outcome. But I would say that the likelihood is that they are not going to be able to get an assault weapons ban through this Congress," NRA president David Keene told CNN's "State of the Union."

Sen. John McCain, R-Ariz., responded with a flat out "no" when asked on CBS' "Face the Nation" whether Congress would pass a ban on assault weapons.

Democratic West Virginia Sen. Joe Manchin, a lifelong member of the NRA has said everything should be on the table to prevent another tragedy like Newtown. But he assured gun owners he would fight for gun rights at the same time. "I would tell all of my friends in NRA, I will work extremely hard and I will guarantee you there will not be an encroachment on your Second Amendment rights," Manchin said on ABC's "This Week."

The NRA's deep pockets help bolster allies and punish lawmakers who buck them. The group spent at least $24 million in the 2012 elections ? $16.8 million through its political action committee and nearly $7.5 million through its affiliated Institute for Legislative Action. Separately, the NRA spent some $4.4 million through July 1 to lobby Congress. Keene insists the group represents its members and not just the gun manufacturers, though he said the NRA would like industry to contribute more money to the association.

"We know what works and what doesn't work. And we're not willing to compromise on people's rights when there is no evidence that doing so is going to accomplish the purpose," Keene said.

The NRA, instead, is pushing for measures that would keep guns out of the hands of the mentally ill, until a person gets better. "If they are cured, there ought to be a way out of it," Keene said.

Currently, a person is banned from buying a gun from a licensed dealer if the person is a fugitive, a felon, convicted of substance abuse, convicted of domestic violence, living in the U.S. illegally or someone who "has been adjudicated as a mental defective or has been committed to any mental institution."

States, however, are inconsistent in providing information about mentally ill residents to the federal government for background checks. And, the Brady Campaign to Prevent Gun Violence said some 40 percent of gun sales happen with no background checks, such as at gun shows and by private sellers over the Internet or through classified ads.

White House responds to Texas secession petition

Responding to petitions from Texas?and seven other states calling for the right to secede, the White House called for?healthy debate, but to not let ?that debate tear us apart.?

?In a nation of 300 million people ? each with their own set of deeply-held beliefs ? democracy can be noisy and controversial. And that?s a good thing,? wrote?Jon Carson, director of the Office of Public Engagement, in a statement called ?Our States Remain United.? ?Free and open debate is what makes this country work, and many people around the world risk their lives every day for the liberties we often take for granted.?

?Whether it?s figuring out how to strengthen our economy, reduce our deficit in a responsible way, or protect our country,? he added, ?we will need to work together ? and hear from one another ? in order to find the best way to move forward.?

The White House?s response addressed nine petitions filed on the White House?s We the People website, which allows any petition to receive a response provided it gets 25,000 signatures. The petition asking for Texas secession, which noted that ?it is practically feasible for Texas to withdraw from the union,? recieved 125,746 signatures. Many of the individuals who signed, however, are not from Texas.

The other state secession petitions addressed in the response came from Florida, Louisiana, Georgia, Tennessee, Alabama, North Carolina and South Carolina.

The response echoes Gov.?Rick Perry?s?statement in November, after the petition gathered steam. His spokeswoman Catherine Frazier said that the governor ?believes in the greatness of our Union and nothing should be done to change it.?

But Americans have a right to be frustrated, she said, adding, ?Now more than ever our country needs strong leadership from states like Texas, that are making tough decisions to live within their means, keep taxes low and provide opportunities to job creators so their citizens can provide for their families and prosper.?

Lawmaker wants federal weapons ban illegal in Texas

THE WOODLANDS -- A Republican lawmaker from The Woodlands says he's trying to make sure the federal government doesn't take away our gun rights.

Don't mess with Texans or their guns. That?s how state Rep. Steve Toth (R-Woodlands) sees it.

Toth wants to make any new federal weapons ban illegal in the state of Texas.

?This is a hardened state. This isn't a good place for a criminal to show up and start shooting,? said Rep. Toth.

So, he?s proposing legislation that would make any federal law banning semiautomatic firearms or limiting the size of gun magazines unenforceable in the Lone Star State.

?We want to make sure this legislation protects the Second Amendment gun rights and the Tenth Amendment which is state sovereignty rights of Texans

This controversial idea comes on the heels of another state lawmaker, Lt. Gov. David Dewhurst, and his views about gun training for Texas teachers.

?In case we've got school personnel with a concealed handgun permit that are in that school and there's an active shooter, we don't want the children harmed we don't want the teacher harmed,? said Lt. Gov. David Dewhurst.

Under his plan, the state would foot the bill for gun training. The decision to allow for concealed weapons on campus would be made district by district.

?You're not turning the schools into an armed camp with a lot of police officers,? said Dewhurst. ?At the same time, you're sending a message if you publicize it to bad people, stay away from our children.?

But the lieutenant governor's idea isn't exactly sitting well with some parents.

?I don't believe in guns, so I believe in ban gun period,? said parent Tina Swangphol.

?Maybe there could be another way,? said parent Patricia Pittman. ?I know they need to be trained, but it shouldn't come out of taxpayer money.?

The debate over teachers and guns will no doubt be a hot topic in Austin, but Rep. Toth believes his proposed Firearm Protection Act will easily pass.

Under his plan, anyone trying to enforce a federal gun ban could be charged with a felony in Texas.

Gay military spouses continue to face hurdles despite 'Don't Ask, Don't Tell'

SANFORD, N.C. ? Ashley Broadway and Army Lt. Col. Heather Mack have been a couple for 15 years. Broadway attended every one of Mack's promotion ceremonies.

The two lived together when Mack served on bases in Texas and Kansas. When Mack was deployed to South Korea, Broadway joined her there. She cared for their young son, Carson, when Mack was sent to Kuwait.

On Nov. 10, the women legally married in Washington, D.C. Broadway began a new life as a military spouse, certain that with the repeal in 2011 of the "don't ask, don't tell" policy that banned gays from serving openly, she would enjoy the same rights as other spouses.

Last month she discovered otherwise when her application to join a base club for officers' spouses at Ft. Bragg, N.C., was turned down. The group's membership director told her she was not eligible because she didn't have a military ID. Broadway believes she was rejected because she's a lesbian. "They don't recognize me as a military spouse because I'm in a same-sex marriage," she said.

Though the spouses club is independent from the military, the denial was a reminder to Broadway of the hurdles still facing same-sex couples.

The 1996 Defense of Marriage Act bans federal recognition of same-sex marriage, which means same-sex spouses don't get benefits afforded to other military wives or husbands. Broadway does not have an Army ID card or access to military healthcare, dental care, education allowances, social programs, legal services or survivor benefits.

Broadway did obtain a "caregiver card" from the Army, which allows her to shop at Ft. Bragg commissaries ? but only for items used by their 3-year-old son, whom the military considers Mack's dependent. Broadway said she was confronted by a clerk when she tried to buy tampons. "Just about the most embarrassing thing that's ever happened to me," she said.

"Basically, this card considers me a nanny, the hired help," she said.

The Pentagon is conducting a "deliberative and comprehensive review" of benefits for same-sex couples, said Lt. Cmdr. Nathan Christensen, a Department of Defense spokesman. Among the possibilities under discussion is providing same-sex spouses the benefits allowed other spouses, "where legally permitted," he said.

Aaron Belkin, a political science professor who helped write the repeal of "don't ask, don't tell," said denying benefits undermines military performance because "the well-being of the family directly affects the readiness of the service member."

The Pentagon should follow the lead of universities and private companies that have found ways to provide benefits to same-sex couples, said Belkin, director of the Palm Center, a research center at the Williams Institute at the UCLA School of Law.

Broadway said she and Mack decided to marry because they believed they could live openly as a married couple in the military. Mack is expecting the couple's second child this month.

"This whole experience with the spouse group has raised much bigger issues than just me getting into a club," Broadway said.

Stephen L. Peters II, president of the American Military Partner Assn., which advocates on behalf of gay military spouses, said some benefits ? including IDs ? are not governed by the Defense of Marriage Act and can be revised through administrative procedures, as the State Department has done.

Last week, the Marine Corps became the first branch of service to order spouse clubs to admit same-sex spouses.

In a memo emailed to corps legal offices around the county, the Marine commandant's staff judge advocate said spouses' clubs were allowed to meet on bases only if they explicitly stated that "no person shall be discriminated against because of race, color, creed, sex, age, disability, or national origin or otherwise subjected to unlawful discrimination."

The memo said: "We would interpret a spouse's club's decision to exclude a same-sex spouse as sexual discrimination because the exclusion was based upon the spouse's sex."

The Army has no plans to address the issue now, said an Army spokesman, Maj. S. Justin Platt.

Benjamin Abel, a Ft. Bragg spokesman, said military authorities there had no direct control over private groups that operate on the base, though they must adhere to Ft. Bragg regulations and federal laws. Abel said the club was not breaking any laws because the Army's stance is that the nondiscrimination clause does not extend to sexual orientation.

Chop, fry, eat: Learning to cook Chinese in China

Chef Pei, who teaches about vegetables available in Beijing markets, holds out a long green bean. Chinese cooking professionals are expected to learn, practice and test proficient in all regional Chinese cooking, including Anhui, Cantonese, Fujian, Hunan, Jiangsu, Shandong, Szechuan and Zhejiang cuisines.

Studying Mandarin is not on my personal bucket list, but becoming more proficient in Asian cooking is.

CHARLESTON, W.Va. -- With an expanding clientele of Chinese business executives, my husband needed to expand his Chinese language skills. Marc signed up for three weeks at Capital Mandarin School in Beijing, which also offered Chinese language and culture day camp for our children, 13-year-old Jeremiah and 10-year-old Caroline. Our daughter was adopted in Shanghai in 2002, so having our kids learn about Caroline's birth country was an appealing idea.

Studying Mandarin is not on my personal bucket list, but becoming more proficient in Asian cooking is. Luckily, there is a special learning center in Beijing catering to the expatriate community -- The Hutong. With all sorts of interesting classes, workshops and lectures on a variety of topics, The Hutong had me spending many days immersed in Chinese cuisine.

I mastered the Beijing subway to get to the school, which is located in -- surprise, surprise -- a hutong neighborhood much closer to the city center. A hutong is a warren of traditional courtyard homes all connected by narrow stone alleyways. (View the fantastic film, "Flying Dragon, Leaping Tiger" to see a good example of a family hutong.)

Hutongs are a very important aspect of Beijing culture, with each having its own legends and stories of the every day people who make up these ancient communities. To this day they are vibrant residential neighborhoods that are the heart of old Beijing. Making my way through the maze of old stone homes, I could sense the benefits available to those living in such a close neighborhood in the middle of a giant metropolis.

In each class, I learned at least three recipes (there's one at the end of this article) as well as some very cool chopping and cutting techniques (think carrot daisies).

To market, to market, to buy a fat ... frog?

Food shopping in a foreign country is a fun challenge. Trying to make sense of labels that aren't in English, searching out familiar corporate logos on packages, or trying to decide if the skinned meat in front of you is frog or chicken.

Early during our Beijing stay, I toured a neighborhood wet market with chef Pei from the school. It's called a "wet" market because of the large amount of water used to keep the fruits, vegetables and floor clean and to keep fish and seafood alive. It was an interesting and educational place to visit, and, yes, it was wet -- not a place to rest your shopping bag or fall down.

In a permanent building less than half the size of Charleston's Capitol Market, thousands upon thousands of fresh food items were for sale. Along our way, Pei pointed out a fruits, vegetables and seasonings I had never seen before and animal body parts I had never considered consumable. And nearly all the produce I'm used to seeing at Kroger was there too -- but in so many more varieties.

Every Chinese locality, from giant metropolis to tiny village, has a wet market. Although cities also have modern grocery stores (complete with produce packed in cellophane and sprayed with preservatives, as we like it in the West), Chinese shoppers are more apt to choose food fresh from the farm whenever possible. In fact, before the SARS outbreak in 2003, it was common to see live mammals and birds waiting to be selected and slaughtered in these markets. Talk about fresh!

From farm to table

One weekend, we traveled northeast by air to Lianing province and drove through the countryside to visit some of Marc's Chinese clients in the city of Anshan. Lianing province is one of China's "bread baskets," and during our drive we were surrounded by one green rolling field after another of corn, sugarcane and soybeans. Despite it being the weekend, folks were out in full force working by the land entirely by hand. During the drive we never saw one farm machine. Although I didn't see any water buffalo, I did see some mule-pulled carts. Dusty little towns sprang up here and there, along with farm stands selling fruits and veggies.

With Chinese cooking being the focus of my Beijing stay, I thought a lot about the available food and its origin. Feeding its own people has been an issue for China throughout the ages. Indeed, only 15 percent of China's total land area can be cultivated. It's a delicate thing to make sure the farming of that 15 percent is done well because the stakes -- the well-being of a huge population -- are so high.

Recent history has shown that upsetting the balance has disastrous consequences. Chairman Mao Zedong's so-called Great Leap Forward campaign of the late 1950s and '60s took farms away from landowners and tenant farmers and forced rural families into collectives, where they had to work and eat together. Mao also called for a nationwide hunt on sparrows, as he thought these little birds were eating too much wheat.

These two campaigns created disaster -- farming inefficiencies in the case of the former and, in the later, the near extinction of sparrows from this part of Asia, causing an imbalance in the natural ecosystem and the proliferation of crop-eating insects. Mass starvation followed; estimates of the human death toll range from 14 million to 43 million.

The communes have long been dismantled, though each farmer still belongs to a collective unit and must provide a quota of specific crops each year in exchange for tools, draft animals, seeds, etc. After meeting the quota, though, a farming family can grow and sell any crops they wish on land they lease.

I was intrigued by the large amount of organic produce available here. I learned that the Chinese government actually pushes organic farming for food safety and health benefits, as well as for profit to be made by exporting in-demand organic food.

I learned about the number of small farms inside city limits, including Beijing. This giant capital city is not exactly in an ideal spot for food production, as it is near the edge of the vast Gobi Desert, which makes up much of the interior of China. No vast fields or ranches here. However, smaller farms within greater Beijing actually provide up to 70 percent of the city's vegetables and milk. The many farms in suburban Beijing ensure that I always found incredibly fresh produce in every market. Can you imagine the same to be true for any American city outside the Sun Belt?

Wielding wok and cleaver

I thoroughly enjoyed my cooking classes at The Hutong. The one-hour each way subway commute, journeying through the hutong alleys to school, and the camaraderie found among my classmates has given my stay in China a unique, fulfilling focus. And of course there's the knowledge I gained of Chinese food preparation and cooking that went a long way to broadening my repertoire of dishes back in my Quarrier Street kitchen:

  • Chinese vegetarian cooking: Seasonal fresh veggies rule, though pickled, dried and preserved have their place.
  • Gourmet pancakes: Recipes right from chef's family kitchen -- scrumptious and fun to make.
  • Shanghai cooking: Sweeter than other regions, less garlic, focus on presentation and balance.
  • Sichuan cooking: Spicy and numbing; a party for the mouth.
  • Dumplings: Time-consuming, fun, delicious and filling; dipping sauces rule.
  • Naturally, each chef at The Hutong taught different styles and recipes, but all accentuated the importance of ingredients. And, the importance of certain ingredients that transcend all regions of China is hammered home, specifically the trio of ginger, spring onions (leeks) and garlic, as well as sesame oil, pepper, peppers, soy sauce (light and dark), vinegar and rice cooking wine.

    The chefs often brought culture into class. For example, we learned from Pei that past shortages of food products led home cooks to strive to get every single speck of flour into their dough -- leaving no flour on the sides of bowl or on the kneading board. Currently, the cost of clean water is driving people to use every speck of dough so that less water will be needed for dishwashing.

Some even think that the "hot" or "cold" properties of foods are so intense that simply eating too many of one can cause you to get sick. For example, if you eat too many "hot" foods (chili peppers, lobster), you might get a rash. Or, eat too many "cold" foods (watermelon, seaweed), and you'll get a stomachache or diarrhea.

    STIR-FRY garlic and ginger until aromatic, then add eggplant and beans.

    ADD seasoning mixture and pepper, and stir well to mix. Garnish with sliced red chili.

    SERVE with rice.

    Deutsche Bank Italia, which for some 15 years had provided the Vatican with electronic payment services, said Thursday that the Bank of Italy had pulled its authorization after Dec. 31.

    The Corriere della Sera newspaper reported that the Italian central bank took the action because the Holy See has not yet fully complied with European Union safeguards against money laundering. That means Italian banks are not authorized to operate within the Vatican, which is in the process of improving its mechanisms to combat laundering.

    The Vatican says it is scrambling to solve the problem for thousands of visitors who flock to its very popular Vatican Museums, which include highlights like the Sistine Chapel. The Holy See had no immediate comment on the Bank of Italy's reported reasons.

    Tourists in the long lines Thursday that snaked around Vatican City walls were not happy about the inconvenience.

    "It's certainly a disadvantage," said Giuseppe Amoruso, an Italian. "Credit cards provide a useful service, which needs to be accessible to everybody, everywhere."

    "A lot of tourists don't have cash on them, so they have to get euros and don't know where to get them," said Fluger William Hunter, an American tourist.

    The central bank said a routine inspection found that Deutsche Bank Italia hadn't sought authorization when it first started providing services at the Vatican. When it finally did, the Bank of Italy turned it down because the Vatican's banking norms, including measures to combat money laundering, didn't meet Italy's more stringent criteria of recent years, a central bank official said, speaking on condition of anonymity because there was no official statement on the case.

    The Vatican has been striving to upgrade its measures to detect and discourage money laundering, hiring a Swiss expert just a few months ago. Last summer, the Holy See passed a key European financial transparency test but received failing grades for its financial watchdog agency and its bank, formally called the Institute for Religious Works.

    The museums, with their entrance fees and popular souvenir shops, are a big money-maker for the Vatican. Other Vatican attractions, such as tours of the Vatican's ancient underground spaces, also charge admission.

    An economy on the cautious upswing, brand allegiance up for grabs, and mobile technology being the linchpin of it all meant that in 2012 loyalty programs achieved newfound relevance in attracting and retaining customers. Consumers opened their wallets this year and sought experience-driven brand engagement. But they did so in caring and cautious ways. It was also the year that a new term, omnichannel loyalty (OCL) not only came into existence, but gained prominence as an outgrowth to the convergence of marketing channels, be it offline, online, and Google?s new term ?nonline.?

    Big Data, a term that?s been around since 2008, became far better understood this year as data gathering and the ability to categorize and act on collected consumer metrics (items purchased, items viewed, ?website navigation, and the measurement of? promotional and page layout impact) reached new levels of proficiency. Yet even with growing awareness, Big Data remains a major area of opportunity ? especially as businesses of all sizes and industries use the insights gained from Big Data to drive business decisions and optimize communication, helping break down siloed corporate divisions. What all this means is that customer engagement and the experiences that effective loyalty programs deliver got a major boost as traditional brick-and-mortar analytics became so complex that brands can now predict and drive future purchases and incremental behavior not just catalog what was purchased. And the more the insights gained from Big Data are used, the better those predictions and ability to impact customer lifetime value will become.

    Organizations as a whole also saw the mobile channel continue to mature as smartphone and tablet adoption rates rose and marketers engaged their customers via these channels in-store, at home and practically anywhere else. Social media like Facebook, Twitter, Foursquare and Pinterest also continued to evolve from simple communication tools to relevant and timely experience promoters.

    As we race towards 2013, the Kobie Marketing team offers four predictions for the New Year:

    • Converge to be Relevant ? Research finds channel coordination and communication between those channels to be the number one challenge in 59% of retail loyalty programs. However, as consumer expectations continue to grow the need for further convergence will become critical in the New Year. The good news is that, as CRM, CEM and Big Data become more manageable (and actionable), program managers are finding new ways to utilize those channels effectively (and identify new ones if necessary) to connect with consumers in timely and relevant ways. That?s a central tenet in the push toward omnichannel loyalty.
    • Digital Insights ? The terabytes of data that are regularly being collected today, and expected to grow another 50-fold by 2020, mean nothing unless that data can be analyzed and acted upon. Today managers can accurately track a host of metrics including SMS opt-ins, click rates, digital coupon redemptions, average price points, guest location in hotels, booking history and even gender (should they desire). Ideally collected anonymously, such a wealth of information helps brands across all verticals form a more accurate consumer picture. The good news here is that many brands agree with this assessment. Nearly 88% of retailers ?strongly agree? or agree that Big Data use was critical to their 2012 ad spending. The question for 2013 is, will your brand be in that 88% and what ways of applying collected data are you already thinking of to improve the loyalty experience and ultimately customer lifetime value?
    • Personalization Becomes Key ? Consumers want their brand interaction to be personal, genuine and on their channel/s of choice, whatever they may be. Although this seems like ?personalization 1.0? brands are still missing opportunities to tailor the customer experience. Beyond the personalized SMS and emails, look to personalize consumer-facing touch points in real time and integrate further with social media through emerging tools like gamification and augmented reality (AR) ? an increasingly popular technology which pulls digital information from web-based sources. That includes sites like Google Maps and social networks like LinkedIn and Facebook.? AR superimposes that data on real-time images of physical world objects such as restaurants (so consumers can browse menus simply by pointing their smartphones at the buildings), hotels, retail stores, airports, etc.
    • Mobile Loyalty ? Considering how technologies and marketing channels are merging, the degree to which data generation from these channels drives positive feedback is critical. And much of that data generation and feedback rests with mobile technology. Adoption numbers alone should tell loyalty marketers and brands that mobile is where they need to be in 2013 if they?re not there already. More than one in four members prefers to access a given loyalty program via mobile. And, according to research by Banyan Branch and VIPdesk, nearly half (47%) of program providers have or are planning to develop a mobile app ? all in an effort to capture the predicted $18 billion that mobile commerce will net by 2014. One of the most interesting developments within mobile as it relates to loyalty came in September with the launch of Apple?s iOS6 software and its newest app, Passbook. Designed as a one-stop-shop to organize users? virtual gift cards, coupons, passes, tickets and loyalty memberships without physical cards, the app?s growing list of brands suggests that companies recognize the fully digital, paperless and card-less world is fast approaching. Call it a smartphone, call it a digital Swiss Army Knife or call it the gadget that gave us Siri?no matter what you call it, it?s where loyalty programs need to be.

    Embrace and act on these four major trends shaping the loyalty industry- mobile, personalization, digital data and convergence ? to make your loyalty program omnipotent and omnipresent in the New Year!

    ANCHORAGE, Alaska (AP) ? The Coast Guard was trying to determine Tuesday whether a strong Alaska storm had abated enough to allow for a helicopter to assess the condition of a drilling rig that ran aground in shallow water off a small island.

    If conditions are safe, the helicopter would also lower experts to the Kulluk to get a close look at the rig and determine if it is leaking fuel, said Curtis Smith, a Royal Dutch Shell PLC employee speaking for a unified command center set up in an Anchorage hotel.

    About 250 people from the Coast Guard, Shell, state responders and others were involved in a response effort and waiting to know for sure what environmental impact the grounding might have caused.

    Storm conditions remained severe Tuesday morning with the grounded rig likely taking a pounding. Winds were reported at up to 70 mph, with waves 35 feet and 45-foot swells. Some waves overnight reached 50 feet, the National Weather Service said.

    The forecast called for both wind and waves easing Tuesday afternoon.

    "We are doing whatever we can do to prepare," said unified command center spokeswoman Destin Singleton said.

    The Kulluk is carrying 150,000 gallons of diesel and about 12,000 gallons of lube oil and hydraulic fluid. "The condition of the Kulluk has not been confirmed," unified command said in a status report issued about 12 hours after the grounding.

    The drilling rig was built with a double-sided hull of reinforced steel that is 3 inches thick, Smith said.

    The drilling rig's difficulties go back to Thursday when it separated from a towing vessel south of Kodiak Island as it was being towed to Seattle for maintenance. The rig grounded Monday night on a sand and gravel shore off the southeast side of Sitkalidak Island, an uninhabited island in the Gulf of Alaska.

    The North Pacific storm that has caused problems for Shell's efforts to move the drill into place near Kodiak Island was expected to ease a bit Tuesday, said spokeswoman Darci Sinclair.

    U.S. Rep. Ed Markey, D-Mass., who is the top Democrat on the Natural Resources Committee, issued a statement Tuesday expressing his concerns about the Kulluk situation.

    "Oil companies keep saying they can conquer the Arctic, but the Arctic keeps disagreeing with the oil companies," Markey said. "Drilling expansion could prove disastrous for this sensitive environment."

    The Kulluk was being towed Monday by a 360-foot anchor handler, the Aiviq, and a tugboat, the Alert. The vessels were moving north along Kodiak Island, trying to escape the worst of the storm. Sitkalidak is on the southeast side of Kodiak Island.

    About 4:15 p.m., the drill ship separated from the Aiviq about 10 to 15 miles off shore and grounding was inevitable, Coast Guard Cmdr. Shane Montoya, the acting federal on-scene coordinator, told reporters.

    "Once the Aiviq lost its tow, we knew the Alert could not manage the Kulluk on its own as far as towing, and that's when we started planning for the grounding," he said.

    The nine-member tug crew guided the drill ship to a place where it would cause the least environmental damage. The tug cut the unmanned ship loose at 8:15 p.m. and it grounded at 9 p.m.

    Susan Childs, Shell's on-scene coordinator, said it was too early to know how the vessel would react to the pounding of the storm when it was aground and stationary. She was optimistic about its salvage prospects and chances for staying intact.

    "The unique design of the Kulluk means the diesel fuel tanks are isolated in the center of the vessel and encased in very heavy steel," she said.

    The drill ship worked during the short 2012 open water season in the Beaufort Sea off Alaska's north coast.

    Tax Exemption ? Employer Supported Childcare | Payroll News and ...


    HMRC LogoThe provision of childcare facilities for children of employees, generally, gives rise to a taxable benefit.? However, Section 318A of the Income Tax (Earnings and Pensions) Act 2003 (ITEPA) allowed a tax exemption on employer-supported childcare provision.? This affected employers who directly-contract to provide childcare or, more commonly, operate a childcare voucher scheme.? The tax exemption value was set as ?50.00 per week for tax year 2005/06, increasing to ?55.00 per week from 06 April 2006.

    From 06 April 2011, Section 318A was amended by the insertion of Section 318AA into the ITEPA 2003, courtesy of the Finance Act 2011.? Section 318AA restricts the level of tax relief to employees who join directly-contracted or childcare voucher schemes on or after 06 April 2011.? The change ensured that the available tax relief is now aligned to the Basic rate of tax, regardless of whether the employee pays tax at the Higher or Additional rate.? Employers now have to perform the Basic Earnings Assessment (BEA) to ascertain the employee?s expected marginal rate in the tax year and then apply the following maximum thresholds:

    Weekly Maximum Tax Relief
    Basic Rate ?55.00 ?11.00 (i.e. ?55 * 20%)
    Higher Rate ?28.00 ?11.20 (i.e. ?55 * 40%)
    Additional Rate ?22.00 ?11.00 (i.e. ?55 * 50%)

    These weekly figures result in monthly and annual thresholds that employers should be operating, expressed as follows:

    As a result of the reduction to the Additional rate from 50% to 45% from April 2013, the Finance Bill 2013 will amend Section 318AA to increase the weekly threshold for these taxpayers to from ?22.00 to ?25.00 per week (i.e. ?25.00 * 45%).? The revision to the rates will ensure that these taxpayers continue to receive the benefit of tax relief at the Basic rate.? 2013/14 rates can be expressed as follows:

    Note that this does not affect employer-provided childcare, i.e. workplace nurseries, where the current exemption remains unchanged.? The term ?tax relief? also applies to relief from National Insurance Contributions and, in this regard, the Finance Bill 2013 will introduce secondary Social Security legislation to align the two tax regimes.

    These changes will apply from 06 April 2013 to employees who joined such a scheme on or after 06 April 2011.? Payroll systems, processes and internal literature may need to be updated as a result of these changes.
